These Terms and Conditions ("Terms") govern your use of actwithshivani.com (the "Platform"). The Platform is operated by [Legal entity name], [Registered address], India ("ActWithShivani", "we", "us" or "our"). When you create an account, book a class or webinar, or otherwise use the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.
1. What we offer
ActWithShivani offers live online training in acting, including multi-session classes and programs ("Classes") and single live sessions ("Webinars"), led by our trainers. Webinars may be free or paid. Sessions are held over video conferencing. All times on the Platform are in Indian Standard Time (IST).
2. Eligibility and accounts
- You must be at least 18 years old to create an account or pay for a booking. Learners under 18 may attend only if a parent or lawful guardian registers, books on their behalf, and accepts these Terms for them.
- You must give accurate, current information and keep it up to date.
- You are responsible for keeping your password confidential, and for all activity under your account. Tell us straight away if you suspect unauthorised use.
- If you book as a guest, these Terms apply to that booking in the same way.
- We may suspend or close an account that breaks these Terms.
3. Bookings
- A booking is confirmed only when you receive a booking confirmation with a booking reference. For paid sessions, this happens after your payment succeeds.
- Seats are limited and allocated on a first-come, first-served basis. If a session is full, you may be offered a place on the waitlist. A waitlist place does not guarantee a seat.
- A Class booking covers every session in that Class as a single unit. Individual sessions cannot be booked or cancelled separately.
- Your booking is personal to you. You may not share joining links or let anyone else attend in your place without our written consent.
4. Prices and payment
- Prices are shown in Indian Rupees (INR). Applicable GST is shown at checkout before you pay.
- Payments are processed securely by our payment partner, Razorpay (or another RBI-authorised payment aggregator), using UPI, cards, net banking or other methods they offer. We do not store your card or banking credentials.
- Coupon codes are subject to their stated conditions, such as expiry dates, usage limits and eligible sessions. They cannot be exchanged for cash. Only one coupon applies per booking.
- We may change prices at any time. Changes do not affect bookings that are already confirmed.
5. Cancellations and refunds
If you cancel
- You can cancel a booking from your dashboard up to 24 hours before the Webinar or the first session of the Class starts.
- If you cancel a paid booking within that window, you get a full refund of the amount you paid.
- After that window, bookings cannot be cancelled online, and no refund is due. This also applies if you do not attend. If you have an exceptional situation, please contact us. Any refund in that case is at our discretion.
- For a Class, missing one or more sessions after it has started does not entitle you to a partial refund.
If we cancel or reschedule
- We may occasionally need to cancel or reschedule a session, for example if a trainer is unwell or for technical reasons. We will tell you as early as we can by email.
- If we cancel a paid Webinar or Class, you can choose a full refund or a transfer to another session of equal value.
- If we reschedule a single session within a Class, we will offer an alternative date. No refund is due for rescheduled sessions.
How refunds are paid
Approved refunds go back to your original payment method within 5–7 business days. The time your bank or card issuer takes to credit it to your account may vary.
6. Attending live sessions
- You are responsible for having a working device, camera, microphone and stable internet connection. We cannot offer refunds for technical problems on your side.
- Please join on time. Trainers may limit entry for late arrivals so that the session is not disrupted.
- Be respectful towards trainers and other participants. Harassment, discrimination, abusive language, or inappropriate content or behaviour is not allowed. The trainer may remove anyone from a session who does this, with no refund.
- Acting exercises can involve movement, voice work and emotional material. Take part within your own physical and emotional limits, and tell your trainer if you need to step back from an exercise.
7. Recordings and intellectual property
- All course content, including session material, scripts, exercises, handouts, recordings, videos, logos and the Platform itself, belongs to ActWithShivani or its trainers and is protected by Indian copyright and trademark law.
- You may use this content only for your personal learning. You may not record, copy, share, resell, broadcast or publish any session or material without our written permission.
- We may record live sessions for quality, training or to share with participants who booked that session. If you do not want to appear on camera in a recording, you may keep your camera off.
- You keep ownership of any work you create. You permit us to use your performance within the session for teaching and feedback. We will not use your image or performance for marketing without your separate consent.
8. No guarantee of results
Our training is meant to develop your craft. We do not guarantee auditions, casting, roles, representation or any particular career outcome. Any references to industry work, or to the success of past learners, are illustrative only.
9. Acceptable use
You agree not to:
- misuse the Platform, interfere with how it works, or try to gain unauthorised access to it;
- create multiple accounts to misuse coupons or offers;
- upload unlawful, offensive or infringing content, including as a profile photo;
- use the Platform for any purpose that is unlawful under Indian law.
10. Limitation of liability
We provide the Platform and our sessions with reasonable care and skill. To the extent the law allows, we are not liable for indirect, incidental or consequential losses. We are also not liable for losses caused by events beyond our reasonable control, such as internet outages or failures of third-party services. Our total liability for any booking is limited to the amount you paid for that booking. Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2019.
11. Third-party services
The Platform uses third-party services such as payment gateways, video-conferencing tools and YouTube. Those services have their own terms and privacy policies, and we are not responsible for them.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Changes apply to bookings made after they are published. If you keep using the Platform, you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of India. We will always try to resolve a complaint with you directly first. If a dispute cannot be resolved that way, the courts at [City], India will have exclusive jurisdiction. This does not affect your right to approach a consumer commission under the Consumer Protection Act, 2019.
